Introduction
These Terms of Service (the “Terms”) cover all use of the bindyr.io website and every service, feature, and tool accessed through it (together, the “Service”). The Service is operated under the trade name Bindyr (referred to here as “Bindyr,” “we,” or “us”). By creating an account or using the Service, you agree to these Terms along with our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service. Bindyr is intended for people who are at least 13 years old.
Obligations of site users
We do not pre-screen every piece of content that users publish to Bindyr, and we cannot guarantee the accuracy, legality, or appropriateness of any user-generated content. By using the Service you accept that you may encounter content that is incorrect, out of date, offensive, or otherwise objectionable, and you agree to take reasonable precautions before acting on anything you see here. Bindyr is not responsible for harm that arises from content posted by users, from outbound links to third-party sites, or from any transaction you choose to enter into with another user or retailer based on information shown in the Service.
You agree not to use the Service to break the law, to harass or impersonate others, to post material that infringes someone else’s intellectual-property rights, to upload malicious code, or to probe, scan, or try to breach the security of the Service. You also agree not to scrape or systematically harvest data from Bindyr except where we explicitly allow it, and not to build a competing product on top of our infrastructure or data exports.
Your account
You can sign in with an email and password or through Google. You are responsible for the activity that happens under your account and for keeping your credentials private. If you suspect someone else has gained access to your account, contact us right away at support@bindyr.io. We may suspend or terminate accounts that violate these Terms, put the Service at risk, or are required to be removed by law.
Your content
You keep ownership of the data you create on Bindyr — your binders, decks, card boxes, notes, profile information, and scanned images. When you mark a binder, deck, profile, or comment as public, you give us a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content as needed to run the Service and to show it to other users. Public content may also appear in search engines and in aggregated views (such as metagame summaries). You can delete your content or your account at any time; deletions are removed from our active systems, and residual copies in backups are overwritten on a rolling schedule.
Magic: The Gathering and third-party content
Bindyr is an independent fan tool. We are not produced, endorsed, sponsored, or affiliated with Wizards of the Coast LLC or Hasbro, Inc. Magic: The Gathering, the mana symbols, card names, card art, and related imagery are trademarks and copyrights of Wizards of the Coast. Card data and images are provided by Scryfall under their terms of use. Pricing information is supplied by TCGPlayer and Scryfall and is informational only; we do not guarantee that any price shown is current or accurate. Purchase buttons link to third-party retailers, and any transaction you make there is solely between you and that retailer.
Third-party services
The Service relies on outside providers to function, including Supabase (database, authentication, and storage), Vercel (hosting), Google (OAuth sign-in, Analytics, and AdSense), Scryfall (card data and images), and retail partners such as TCGPlayer and Card Kingdom. Your use of those providers through Bindyr is also governed by their own terms and privacy policies. We do not control those services and are not responsible for their availability or conduct.
Advertising
Bindyr is supported in part by advertising. Ads are served by Google AdSense and its partners, and may be personalized based on your prior activity on this and other websites unless you opt out through your Google account settings. We do not directly control the ad creatives that appear on the Service. If you see an ad that appears to be malicious or misleading, please let us know at support@bindyr.io.
Availability and changes
Bindyr is under active development. Features may be added, modified, or removed without notice, and the Service may be unavailable from time to time for maintenance or unexpected outages. The Service is provided on an “as is” and “as available” basis, with no warranty of uptime, accuracy, fitness for a particular purpose, or freedom from bugs. You are responsible for keeping your own backups of any data that matters to you, including by using the export options we provide.
Disclaimers and liability
To the fullest extent permitted by law, Bindyr and everyone who operates it disclaim all warranties, whether express or implied. We are not liable for indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Service, including lost data, lost profits, missed trades, or incorrect pricing. Our total liability to you for any claim connected to the Service is limited to the greater of (a) USD $50 or (b) the amount you actually paid us for the Service in the twelve months before the claim.
Indemnification
You agree to defend, indemnify, and hold harmless Bindyr and its operators from any claim, demand, loss, or expense (including reasonable attorneys’ fees) that arises out of your use of the Service, the content you post, or your violation of these Terms or the rights of another person or entity.
Termination
You can stop using the Service and delete your account at any time. We can suspend or terminate your access if you break these Terms, if keeping you active would put the Service at risk, or if the law requires it. Provisions that by their nature should survive termination — including rules about content licenses, disclaimers, liability, indemnification, and dispute resolution — continue to apply after your account is closed.
Changes to these terms
We may update these Terms from time to time. When we make meaningful changes we will update the “Last updated” date at the top of this page and, where appropriate, give additional notice (such as an in-app message or email). If you keep using the Service after an update, that means you accept the revised Terms.
Governing law and disputes
These Terms are governed by the laws of the State of Oregon, USA, without regard to its conflict-of-law rules. You agree that any dispute you bring against us will be resolved exclusively in the state or federal courts located in Oregon, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any rights you have as a consumer under mandatory local law.
